E-shop terms of sale

Purpose and scope of the terms

1) The following terms and conditions apply to the legal relationships between the person making purchases in the e-shop at spavarska.ee (hereinafter referred to as the Buyer) and the e-shop owner (hereinafter referred to as the Company) when purchasing products and services. In addition to these terms and conditions, the legal relationships described above are also regulated by the laws of the Republic of Estonia.

2) For the purposes of these terms and conditions, the Company that owns the e-shop is AS Värska Sanatoorium with registration number 10243330, which operates at the address Väike-Rõsna küla, 64034, Setomaa vald, Võru maakond, Republic of Estonia. The e-shop customer service can be contacted by phone at +372 7993901 every day from 7 am to 11 pm Estonian time and by e-mail at info@spavarska.ee, to which letters received are generally answered within two business days.

3) The items for sale in the e-shop are gift cards, which are specially designed based on the needs of the Buyer. The gift card can be used to pay for all Värska Spa and Wellness Centre services during its validity period up to the value of the gift card.
There are two types of gift cards:
1) an e-gift card, which is issued in digital form via e-mail;
2) a regular gift card, which is issued in physical form at the service counter or by regular mail.
The buyer can specify the amount of the gift card, write a personal message for the recipient of the gift card, and in the case of e-gift cards, choose a suitable design. When purchasing a gift card, the buyer or the recipient of the gift card designated by him will be issued a unique product code, which can be used to pay for Värska Spa and Wellness Centre services at the service counter of the Sanatorium or Water Centre.

4) If the Buyer is between 7 and 18 years of age or a person with limited legal capacity, he confirms when making a purchase that his legal representative or guardian has approved the transaction to be concluded with the Company or he makes the purchase with funds that have been given to him for this purpose or for free use by his legal representative or a third party with the latter’s consent.

5) These terms and conditions do not regulate the subsequent use of Värska Spa Treatment Services services (e.g. accommodation, ordering alcoholic beverages to the room), which may be subject to other restrictions arising from the law.

Price and payment

6) The price of the gift card includes the VAT valid in Estonia. In the case of an e-gift card, no additional fees are added to the value of the gift card. In the case of a regular gift card, a handling and shipping fee may be added to the value of the gift card upon purchase, according to the selected delivery method, about which the Buyer can find information in advance on the product page of the specific gift card, and the additional fee is also displayed as a separate line in the e-shop shopping cart before being directed to the payment environment.

7) Payment for the gift card is made in advance via a bank link, by transfer or by credit card in the payment environment associated with the e-shop. Immediately after making the payment, the Buyer must click on the «Return to merchant» button to immediately register the payment.

Delivery conditions

8) The e-gift card is issued to the e-mail address specified by the Buyer either immediately after payment or on the date specified by the Buyer on the gift card product page at 00:00.

9) Depending on the selected delivery method, a regular gift card is issued either from the counter of Värska Sanatorium and Water Center or sent to the postal address specified by the Buyer by regular mail within 2 working days. The delivery time of a gift card sent by regular mail depends on the postal company.

Use

10) The gift card can be used to pay for all products and services of Värska Spa Treatment Center at the service counters of the Sanatorium or Water Center within the value or free balance.

11) Another gift card cannot be purchased with the gift card.

12) When using a gift card at the counter of Värska Sanatorium or Veekeskus, you must present its unique 12-digit code, show the gift card to the counter attendant to enter the code from your smart device, or give the gift card in printed form. An e-gift card does not need to be printed.

13) The Buyer of the gift card or the person who received it as a gift ensures that the gift card code does not fall into the possession of third parties who are not entitled to use the gift card.

14) The gift card code may only be used to pay for the services and products of Värska Spa and Wellness Centre by the person entitled to do so – the Buyer who purchased the gift card, the person designated by the Buyer as the recipient of the gift card, or the person authorized by the recipient of the gift card. In case of reasonable suspicion, the staff of Värska Spa and Wellness Centre reserves the right to suspend the provision of services paid for with the gift card until all circumstances have been clarified.

15) If the cost of the goods and services selected by the gift card user exceeds the value of the gift card or the free balance, the user must pay the missing amount.

16) If the cost of the goods and services selected by the gift card user is less than the value of the gift card, the free balance remaining from the previous purchase can be used later until the end of the gift card validity period. The number of purchases is not limited.

17) The authorized person has the opportunity to receive information from the Company about the free balance and validity period of the gift card by submitting a corresponding request through the e-shop or the Company’s contacts.

Validity period

18) The gift card is valid for up to 12 months from the moment of its purchase, unless a shorter validity period is indicated on the gift card product page.

19) The last day of the gift card’s validity is indicated on the bottom edge of the card in the format day/month/year (e.g. on April 11, 2021, the gift card is valid for the last day – 11/04/2021).

20) After the validity period has expired, the gift card can no longer be used as a means of payment and will be cancelled.

21) Individual services paid for with the gift card must be used before the card’s validity period expires. In the case of treatment or relaxation packages, the package must have started and the gift card code must be presented for payment before the gift card’s validity period expires.

Right of return

22) The purchased gift card cannot be returned or exchanged for money after it has been issued. There is no possibility of return when purchasing gift cards, as the gift card with a monetary value is designed according to the Buyer’s personal needs.

Protection of personal data

23) The Company follows the General principles of Data Processing and Cookie Use adopted by AS Värska Sanatoorium when processing personal data collected when using the online store. The Company forwards the personal data necessary for making payments to the authorized processor Maksekeskus AS. The Company does not disclose personal data to other parties without the Buyer’s consent.

Other

24) Disputes arising between the Buyer and the Company in connection with the use of the online store shall be resolved through negotiations. A question or claim must be submitted to the contacts specified in clause 2 of these terms and conditions in a reproducible manner and within a reasonable time from the moment the circumstances of the case become known. If an agreement is not reached, the Buyer has the right to contact the Consumer Protection Board or the court.
